We take your privacy seriously and we respect your right to privacy when you use ("User") our websites, our online forms, our eShop online, our pages on social networks, and whenever else you communicate with us, including electronic transmission of any kind of data, personal or other, photos and files, or data included in contact, reservation, booking, survey or other forms (“Personal Data”). This is part of our ongoing commitment to delivering services of highest quality ("Digital Services), whether in the way we present information, offer products and services, and collect your data or in any way how we approach you, using our websites or other IT.

“We”, “us” and “our” refer always to Alcaxua, Lda. ("the Enterprise") and never to an individual person, in any case to a single member of the Entreprise.

We collect, use and are responsible for the Personal Data about you. When we do so we are subject to the General Data Protection Regulation, which applies across the European Union and the United Kingdom, and we are responsible as ‘controller’ of that Personal Data for the purposes of those laws. We are the data controller when processing your Personal Data in the conditions described in this Privacy Policy.

Before using our Digital Services, please read this Privacy Policy, as well as our Terms & Conditions (the "Website_Rules"). If you do not agree to this Privacy Policy or to the Website_Rules, please do not use our Digital Services.  

1. Personal Data

Personal Data means any information that can be used to personally identify you or contact you online or elsewhere, as well as other broader information collected about you with the purpose of offering our services and products.

We may collect and use the following Personal Data about you: 

• your name and contact information, including postal address, email address and telephone numbers, information for tax purposes, namely your Tax ID, personal ID or passport number or  and, if applicable, company details, including the VAT ID number

• information to enable us to verify your identity, including your date of birth and your gender, if you submit this to us, as well as other user profile information

• your billing, transaction and payment information

• your personal or professional interests and preferences, including your online presence and accounts

• your contact, enquiry and purchase history, and other related items

• information about how you use our website, IT, communication and other systems 

• your IP address and your mobile / tablet / device ID, and your location data

• your responses to our enquiries and commercial or other proposals

• information provided to us for your attendance at our location Lugar Minas da Caveira, meetings and events you attend, as well as information about access or dietary requirements.

This Personal Data is required to provide our products and Digital Services to you. If you do not provide Personal Data we ask for, it may delay or prevent us from providing products or services to you.

You agree that at our own discretion we may make public some or all information transmitted by you through online forms or other written forms, which are explicitly marked for the purpose of public use;, including but not limited to:

• Use of our Guest Book or Blog forms online

• Use of information tansmitted during or regarding your attendance of online or other events at Lugar Minas da Caveira

• Use of text, photo or video material that you provide to us and you have marked as for public use.

2.2. Personal Data we collect from other sources 

We may also collect information and Personal Data:

• directly from a third party, if this is one of our partners or with your consent, including from your bank or insurance

Subject to applicable laws, we may use some information about who uses our Digital Services, which we get from third parties such as Google or social media that you use.  Some of this Information that we collect can’t be linked to you individually, but if we can link it to you, then we treat it in accordance with this Privacy Policy.

Under data protection law, we can only use your Personal Data if we have a proper reason for doing so, e.g.:

• When you use a QR Code or equivalent feature displayed on our material or digital products: we use your Personal Data to send you more information on the products where the QR code or equivalent feature was displayed

• Feedback, questions, or comments through our ‘Contact’ form or Guest Book online: if you contact us via an online contact form, your information is used to respond to your inquiry or comment

When you submit your Personal Data, you may also be given the option to have your information used for an activity or service different from the one you are requesting.

We may also use your email address to send you transactional or administrative communications such as confirmation emails when you sign up for, or unsubscribe from, a specific registration or activity. We may also use it for certain service-related announcements, such as updates to our Privacy Policy, discontinued features on our Digital Services or changes to our products or services.

We retain your Personal Data in our user database which allows us to ensure that your Personal Data remains accurate and up to date.

If you choose not to submit any Personal Data when requested, you may not be able to participate in certain activities or use some of the personalised features of our Digital Services. This may also limit the services and some offers we can provide you. However, you do not need to give us any Personal Data to simply browse our websites and learn more about us and our products. 

4. Disclosure of Personal Data

We will not share your Personal Data with any third party, unless you have been specifically informed and you have given us explicit permission to do it, as in the case of shared services with a third party:

5. Personal Data storage 

We may store your Personal Data in our databases or databases from our service providers, and you agree that Personal Data may be transferred to and stored in

We will not retain your Personal Data for longer than necessary for the purposes set out in this policy. Different retention periods apply for different types of Personal Data.

We may also need to retain your Personal Data to comply with our legal and regulatory obligations, resolve disputes or enforce our agreements. 

We may also retain your Personal Data for a reasonable period after you stop using our services or Digital Services. After this period, your Personal Data will be deleted.

6. Cookies Policy

A cookie is a small text file that is saved on a User's end device when he or she is visiting a website. Cookies can help for instance to recognise a user who repeatedly is visiting a website.

The User of our websites is notified about the use of cookies through the information in this Privacy Policy or when he or she visits one of our websites for the first time or after having deleted previously used cookies.

There are several cookies, which are absolutely necessary to keep the minimal functionality the Websites. These are stored on the User's end device when the Websites are visited.

• correct any mistakes in your personal data 

• delete your personal data - in certain situations 

• restrict processing of your personal data, if you contest the accuracy of the data.

If your Personal Data has been processed on the basis of your consent, you can withdraw your consent at any time.

Your objection (or withdrawal of consent) may mean we cannot provide the products or services you have requested of us or you may not be able to use the services we offer. In certain circumstances even if you withdraw your consent we may still be able to process your Personal Data if required or permitted by law or for the purpose of exercising or defending our legal rights or meeting our legal and regulatory obligations.    

If you participated in a program that involved a third party and you agreed to receive communications from that third party, you will need to contact them directly to opt-out. This process should be outlined in the third party’s privacy policy. 

8. Personal Information about Children

Our Digital Services are not intended for children under the age of majority (“Minor”), so we do not knowingly collect Personal Data from Minors. You must be at least eighteen years old to create an account and engage in activities and transactions on our Digital Services. By creating an account or engaging in activities or transactions, you confirm that you are at least eighteen years old and are fully able to enter into, comply with and be legally bound by our any terms of use made available to you and this Privacy Policy. If we are notified or learn that a Minor has submitted personal data to us through our Digital Services, we will delete their Personal Data.

Minors accompanied by their parents or representatives, or presenting a legal and valid document empowering them to use our services or Digital Services will be treated as such individually and identified as Minor in our databases. This is the case when we offer accomodation or other services in our location Lugar Minas da Caveira.

Our Digital Services may contain links that will direct you to other websites or services that are operated and controlled by third parties. This includes links from advertisers, sponsors and partners.

11. Amendments to this Privacy Policy

We may update this Privacy Policy. If necessary, you will be notified of any material changes using the email address you have provided upon registration or by an announcement on the site. The changes will apply to the use of the site after such notice. Where permitted by law, if you use the site after the date on which the changes come into effect, you will be deemed to have accepted the new Privacy Policy.
